New York City’s Biometric Identifier Information Law (Administrative Code §22-1201) takes effect today, regulating how commercial establishments collect and use customers’ biometric data.
Key points
- Applies to commercial establishments such as retail stores, food and drink venues, and places of entertainment.
- Businesses collecting biometric identifiers, such as face geometry or fingerprints, must post a clear and conspicuous sign at customer entrances.
- Selling, leasing, trading or otherwise profiting from biometric identifier information is prohibited.
- Customers have a private right of action, with statutory damages per violation.
UK brands with New York stores or venues, and suppliers of camera analytics, need to review signage, data sharing and vendor contracts. The law adds to a growing patchwork of US biometric rules alongside Illinois BIPA.
