Germany’s TTDSG comes into force

Germany’s Telecommunications Telemedia Data Protection Act takes effect, tightening consent rules for cookies and similar technologies.

Germany’s Telecommunications Telemedia Data Protection Act (TTDSG) comes into force today, consolidating the privacy rules for telecoms and online services that were previously spread across the Telecommunications Act and the Telemedia Act.

Key points

  • §25 requires consent for storing or accessing information on end-user devices, such as cookies.
  • Limited exemptions apply where access is strictly necessary for a requested service.
  • The law implements the ePrivacy Directive in German law.
  • German regulators are expected to enforce strictly.

UK organisations with websites or apps targeting German users should review their consent mechanisms, cookie banners and use of tracking technologies, as German regulators and courts take a strict view of what counts as valid consent.
