The Consumer Rights Act 2015 comes into force today, consolidating UK consumer law and, for the first time, creating specific rights for digital content.
Key points for digital content suppliers
- Digital content supplied to consumers must be of satisfactory quality, fit for purpose and as described.
- Where defective digital content damages a consumer’s device or other digital content, the trader may have to repair the damage or pay compensation (section 46).
- Consumers have remedies including repair, replacement and price reduction.
Information security link: software, apps and updates that introduce malware or vulnerabilities could give rise to liability. Secure development practices, testing and vulnerability management are now as much a legal protection as a technical one.
