TAKE IT DOWN Act platform removal duties take effect in the US

Covered platforms must now remove reported non-consensual intimate imagery, including AI deepfakes, within 48 hours of a valid request.

The platform obligations of the US TAKE IT DOWN Act take effect today, one year after the law was signed.

Key points

  • Covered platforms must operate a clear notice-and-removal process for non-consensual intimate imagery.
  • Reported content must be removed within 48 hours of a valid request.
  • Platforms must make reasonable efforts to remove known identical copies.
  • The Federal Trade Commission enforces the duties, treating failures as unfair or deceptive practices.

UK organisations running websites, apps or online communities that host user content and serve US users should make sure their reporting channels, moderation workflows and response times meet the new requirements.
