Texas and Illinois AI laws take effect

The Texas Responsible AI Governance Act and Illinois’ AI-in-employment law both come into force, adding to US state AI regulation.

Two significant US state AI laws take effect today: the Texas Responsible Artificial Intelligence Governance Act (TRAIGA) and Illinois’ amendments to its Human Rights Act on AI in employment (HB 3773).

Key points

  • TRAIGA prohibits developing or deploying AI with intent to manipulate people to self-harm, unlawfully discriminate or produce certain unlawful content.
  • TRAIGA gives the Texas Attorney General enforcement powers and creates a regulatory sandbox.
  • Illinois prohibits employers from using AI in ways that discriminate against employees and applicants on protected characteristics.
  • Illinois employers must notify workers when AI is used in employment decisions.

UK organisations using AI in recruitment or customer-facing services involving Texas or Illinois should review their AI governance and notices.
